Don’t Miss Out on the First Time Homebuyer Tax Credit!!!

UNCLE SAM WANTS YOU – to buy a house!

As you may know, first time homebuyers (including people who have not held an interest in real property in three years) may be eligible for a federal tax credit of up to $8,000 on homes purchased by December 1, 2009.  This is an unprecedented opportunity to get something for free from the federal government and we don’t want you to miss out!

If you are planning to take advantage of the federal tax credit, you must close no later than December 1, 2009.  To assure that your closing takes place by that date, we recommend that you have a property under contract by October 26, 2009, to allow ample time for your appraisal and lending to be completed (if you’re paying cash, lucky you; you can wait longer).

But, even better – the State of Texas will lend you a portion of your credit up front to use as the down payment!  The Texas Department of Housing and Community Affairs recently announced the 90-Day Down Payment Assistance Program.  Through this program, TDHCA has made available $5 million in down payment assistance to be used in conjunction with first mortgages originated at a participating, approved lender.  What does this mean to you?  Instead of waiting to get your tax refund, you can borrow a portion of your credit, interest free, for 90 days from the state of Texas.  You can then amend your 2008 taxes, receive your credit and refund, and pay off your loan.  90 days provides a generous time frame to get your paperwork completed.

Recovery – how is Austin doing? Three news stories.

Any real estate professional will tell you one thing: all real estate is local. So, even though national trends might influence our Central Texas market, unique factors – including location, economy, and how the market was before the mortgage crisis – all make our market unique.

There are signs that we’re doing pretty well here in Central Texas.  As the articles below explain in detail, we’ve had some strong signs of recovery.  First, sales of existing homes hit their highest level in a year in July 2007.  Second, tax foreclosures have declined to their lowest level in five months.  Finally, analysts believe that many Texas cities, such as Austin, San Antonio, Dallas, and McAllen, are poised for swift recovery – not only because they did not see the massive real estate bubble that formed in states like California, Nevada, and Florida, but also because Texas’s economy is diverse, with heavy growth coming from education and health care in recent years.

Tip of the month:

Although it still feels like the sweltering days of summer, this is the time to begin planting your fall garden.  According to the Travis County Agricultural Extension Agent, August 1-15 is prime time to plant lima beans, snap beans, broccoli (and broccoli rabe!), carrots, cauliflower, chard, chinese cabbage, sweet corn, cucumbers, fennel, garlic, kale, okra, black-eyed peas, potatoes, rutabaga, shallots, New Zealand spinach, summer squash, and winter squash.  Check out more gardening information for our area here:  http://www.co.travis.tx.us/agext/garden/veggies/planting/

 

HUD’s Tips for Avoiding Foreclosure

Are you having trouble keeping up with your mortgage payments? Have you received a notice from your lender asking you to contact them?  The U.S. Department of Housing and Urban Development (HUD) gives this important advice:

If you are unable to make your mortgage payment:

1. Don't ignore the problem -- the further behind you become, the harder it will be to reinstate your loan and the more likely that you will lose your house.

2. Contact your lender as soon as you realize that you have a problem.  Lenders do not want your house. They have options to help their borrowers through difficult financial times.   

3. Open and respond to all mail from your lender. The first notices you receive will offer good information about foreclosure prevention options to help you weather financial problems.  Later mail may include important notice of pending legal action.  Your failure to open the mail will not be an excuse in foreclosure court.

4. Know your mortgage rights.  Find your loan documents and read them so you know what your lender may do if you can't make your payments.  Learn about the foreclosure laws and timeframes in your state (as every state is different) by contacting the State Government Housing Office (here in Texas, it’s the Texas Department of Housing and Community Affairs - http://www.tdhca.state.tx.us).  

5. Understand foreclosure prevention options. Valuable information about foreclosure prevention (also called loss mitigation) options can be found on the internet at

6. Contact a HUD-approved housing counselor. HUD funds free or very low cost housing counseling nationwide.  Housing counselors can help you understand the law and your options, organize your finances and represent you in negotiations with your lender if you need this assistance.

7. Prioritize your spending. After healthcare, keeping your house should be your first priority.  Review your finances and see where you can cut spending in order to make your mortgage payment.  Look for optional expenses – cable TV, memberships, entertainment – that you can eliminate. Delay payments on credit cards and other "unsecured" debt until you have paid your mortgage.

8. Use your assets.  Do you have assets – a second car, jewelry, a whole life insurance policy – that you can sell for cash to help reinstate your loan? Can anyone in your household get an extra job to bring in additional income?  Even if these efforts don't significantly increase your available cash or your income, they demonstrate to your lender that you are willing to make sacrifices to keep your home.  

9. Avoid foreclosure prevention companies.  You don't need to pay fees for foreclosure prevention help – use that money to pay the mortgage instead. Many for-profit companies will contact you promising to negotiate with your lender.  While these may be legitimate businesses, they will charge you a hefty fee (often two or three months mortgage payment) for information and services your lender or a
HUD approved housing counselor will provide free.

10. Don't lose your house to foreclosure recovery scams! If any firm claims they can stop your foreclosure immediately if you sign a document appointing them to act on your behalf, you may well be signing over the title to your property and becoming a renter in your own home!  Never sign a legal document without reading and understanding all the terms and getting professional advice from an attorney, a trusted real estate professional, or a
HUD approved housing counselor.
